Halton BFI Policy

Policy Statement

A policy to ensure that all breastfeeding mothers have the right to breastfeed in a public place and to be accommodated at work.

Application

To all employees, elected and appointed representatives, contractors and the general public.

Definitions

Breastfeeding - includes pumping or expressing milk, as well as nursing directly from the breast.

Employee/Contractor - refers to all employees, including unionized, non-unionized, and management staff. A contractor is any person other than an employee who performs work or supplies services for monetary compensation.

Flexible work time - refers to providing time for mothers to accommodate breastfeeding when required (preferably on a mutually agreed upon schedule between the employee and employer). This may include altering the times of breaks and/or combining breaks. “Employees should not be asked to forgo normal meal breaks to make up for any additional time needed to breastfeed**.”

Management - refers to persons who supervise employees as part of their job description.

Support- refers to a positive attitude by the Corporation, management, and staff towards all breastfeeding mothers (employees and/or members of the general public) and their infants. This involves respecting the rights of mothers who wish to breastfeed in any public location and/or facility. Support is demonstrated by making all reasonable efforts to provide private, clean, comfortable, and safe space. Flexible work time schedules for breastfeeding employees should also be provided.

Workplace - refers to any land, premises, or location at, upon, in, or near where an employee works.

Responsibilities

Management:

  • Support breastfeeding mothers within the Corporation’s facilities by ensuring staff/members of the general public are accommodated with respect to time/space as per the Ontario Human Rights Code.
  • Support the right of breastfeeding employees upon their return to work in accordance with the Ontario Human Rights Code.
  • Support breastfeeding employees to establish a flexible, mutually agreed upon work time schedule to breastfeed (or express breastmilk), while at work.
  • Make all reasonable efforts to ensure that employees have access to a private, clean, comfortable and safe space for breastfeeding at, upon, in, or near the workplace.
  • Ensure employees are aware of the Corporation’s support of breastfeeding mothers and the availability of breastfeeding resources while on Regional premises.

Employees and contractors:

  • Support rights of breastfeeding mothers (employees and/or members of the general public) when on the Corporation’s premise.
  • Prior to returning from parental/pregnancy leave, notify management of the need for breastfeeding accommodation in order to establish a mutually agreed upon work schedule.
  • Provide all equipment and supplies needed for expressing and storing breastmilk. An ice pack is appropriate for storage.
  • Leave the space utilized for breastfeeding in a clean and organized manner. Discuss ongoing breastfeeding needs with immediate supervisor to achieve a mutually agreed upon work schedule.
